Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and PeopleCheck Online LLC ("PeopleCheck", "we", "us"). They govern your access to and use of peoplecheck.online and every related application, API and report (together, the "Service"). By creating an account, running a search, or paying us any amount, you accept these Terms. If you do not accept them, do not use the Service.
These Terms take effect on the date shown at the top of this page in the site footer.
Not a consumer reporting agency
PeopleCheck is not a consumer reporting agency ("CRA") as that term is defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. ("FCRA"), and the information we return is not a "consumer report" under the FCRA.
We do not collect or assemble information for the purpose of furnishing consumer reports, and we do not verify the accuracy of the public and third-party data we surface.
You may not use PeopleCheck, in whole or in part, as a factor in establishing any person's eligibility for:
- employment, promotion, reassignment or retention as an employee;
- credit, a loan, or any extension of credit;
- housing, tenancy or tenant screening;
- insurance underwriting or pricing;
- a professional or occupational licence;
- any government benefit or licence granted on applicant financial capacity; or
- any other purpose that is a "permissible purpose" under 15 U.S.C. § 1681b.
If you need information for any of those purposes, you must obtain it from a properly licensed consumer reporting agency that complies with the FCRA, including its adverse-action and dispute obligations.
You additionally may not use the Service to stalk, harass, intimidate, threaten, defraud or discriminate against any person, or in any way that violates the Driver's Privacy Protection Act, the Gramm-Leach-Bliley Act, any state anti-doxxing or anti-stalking statute, or any equivalent law of the United Kingdom or Canada.
Accounts used for a prohibited purpose are terminated without refund, and we reserve the right to report the activity to the relevant authorities.
1. What the Service actually is
PeopleCheck is an open-source-intelligence ("OSINT") aggregation tool. You give us a name, a profile URL, an email address, a phone number or a username. We search publicly accessible sources and licensed third-party data suppliers, normalise what comes back, and present it as a structured report together with a rule-based Trust Score.
Three things follow from that, and you should read them carefully:
- We do not create data. Everything in a report originated with a third party or with a public posting made by, or about, the subject.
- We do not verify data. A high Trust Score means the sources we could reach agreed with one another. It is not a statement that any fact is true.
- The Trust Score is deterministic, not artificial intelligence. It is a published set of weighted rules. Every point added or removed is itemised in the report, and you can inspect the reason for each one. No large language model generates or interprets your report.
2. Eligibility and territory
You must be at least 18 years old and legally capable of entering a contract.
The Service is offered to residents of the United States, the United Kingdom and Canada only. We block traffic originating in the European Economic Area and we do not offer the Service there. Attempting to evade that block — via a VPN, proxy or otherwise — is a breach of these Terms.
If you are in Quebec, in a US state with a comprehensive privacy statute, or in the United Kingdom, you have additional rights described in our Privacy Policy; nothing in these Terms limits them.
3. Your account
You are responsible for everything that happens under your account, for keeping your password confidential, and for telling us promptly at support@peoplecheck.online if you believe it has been compromised. We may suspend an account immediately, without notice, where we reasonably believe it is being used for a purpose prohibited by the FCRA section above, for automated scraping, for payment fraud, or in a way that endangers the Service or another user.
4. Subscriptions, trials and billing
Plans. Current plans, prices and included quotas are shown on the Pricing page. Prices are in US dollars unless stated otherwise, and are exclusive of any sales tax, VAT or GST we are required to collect.
Recurring billing. Paid monthly plans renew automatically at the then-current price at the end of each billing period until you cancel. By subscribing you authorise us, and our payment processor, to charge your payment method on each renewal date.
Trials. Where a plan includes a trial, we disclose the trial length, the trial charge (if any) and the price that follows it, on the checkout page, before you pay. A trial converts to a paid subscription automatically at the end of the trial period unless you cancel first.
Cancellation. You may cancel at any time from Billing in your dashboard. Cancellation stops the next renewal. It does not retroactively refund the current period; see the Refund Policy.
Failed payments. If a renewal fails we will retry it over a short dunning window and email you. Access is suspended if the balance remains unpaid.
Price changes. We will give at least 30 days' notice by email before any price increase affects your renewal, and you may cancel before it takes effect.
5. Fair use of quotas
Plans that advertise "unlimited" searches are subject to fair use: unlimited means unmetered ordinary human use, not automated bulk querying. We may rate limit, and will contact you before taking any other action, where usage in a 30-day window materially exceeds normal use for your plan.
API access, where included in your plan, is additionally subject to the rate limits published in the API documentation.
6. Acceptable use
You agree not to:
- use the Service for any purpose prohibited by the FCRA section above;
- resell, sublicense or redistribute report content, or build a competing database from it, without our written agreement;
- scrape, crawl, or use automated means to access the Service outside the documented API;
- circumvent quotas, paywalls, rate limits, or the geographic restriction;
- upload malicious code, probe our infrastructure, or interfere with other users' access; or
- misrepresent your identity or your reason for running a search.
7. Reports, licence and retention
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to view, download and use reports for your own lawful personal or internal business purposes.
Reports are retained for the period stated in your plan's entitlements. After that they are deleted from your dashboard. Underlying cached source data is subject to the retention schedule in the Privacy Policy.
8. Third-party data suppliers
We rely on third-party suppliers and public sources. Their availability, coverage and accuracy are outside our control. If a supplier is unavailable, a report may return fewer sections; the report will always tell you which providers contributed and which did not.
9. Subjects of reports
If you are the subject of a report and want your information suppressed, use the "Do Not Sell or Share My Personal Information" link in the site footer, or write to privacy@peoplecheck.online. We maintain a permanent suppression list; a canonical record placed on it is excluded from all future search results.
10. Disclaimers
THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE INFORMATION IN A REPORT IS ACCURATE, CURRENT, COMPLETE OR RELATES TO THE PERSON YOU INTENDED TO SEARCH.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Consumers in the United Kingdom retain their rights under the Consumer Rights Act 2015; consumers in Canada retain their rights under applicable provincial consumer protection legislation.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED US DOLLARS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL.
12. Indemnity
You will indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your use of the Service in breach of these Terms, and in particular from any use of a report for an FCRA-regulated purpose.
13. Suspension and termination
You may close your account at any time. We may suspend or terminate access for material breach of these Terms, for non-payment, or where required by law. On termination your licence ends and your reports become inaccessible; our retention obligations in the Privacy Policy continue to apply.
14. Changes to these Terms
We may update these Terms. Material changes are announced by email and in-app at least 14 days before they take effect, and the version number at the foot of this page changes. Continuing to use the Service after that date is acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction, except that:
- if you are a UK consumer, you may bring proceedings in the courts of England and Wales, or of your home nation within the UK, and mandatory UK consumer law applies to you; and
- if you are a Canadian consumer, you may bring proceedings in the courts of your province of residence, and mandatory provincial consumer law applies.
